Please read these Terms and Conditions carefully before booking or occupying any vacation rental property offered through Florida4Fun.
These Terms and Conditions define the rights and responsibilities of the Property Owner/Manager and the Guest and shall govern all reservations made through Florida4Fun. By confirming a reservation, making a payment, or occupying a property, the Guest acknowledges that they have read, understood, and agreed to these Terms and Conditions.
Early check-in and late check-out may be available upon request and are subject to availability and additional fees.
Acceptance of these Terms creates a binding agreement between the Reservation Holder (“Guest”) and the applicable Property Owner and/or Property Manager.
All individuals listed on the Reservation Confirmation, Rental Agreement, or subsequently added to the reservation are subject to these Terms and Conditions. Only registered guests may occupy the property. The Reservation Holder (“Primary Guest”) is responsible for the conduct of all members of the party throughout the stay. All reservation-related communications will be directed to the Primary Guest.
A reservation is confirmed only after it has been approved by the Property Owner/Manager and the required payment has been successfully processed. Florida4Fun offers the following payment methods:
Guests paying through Brazilian PIX will complete the transaction using our secure payment platform. After entering the required information, the system will generate a PIX QR Code and/or PIX payment code to complete the payment. Reservations are confirmed only after payment authorization has been successfully received.
Guests using a Brazilian-issued credit card will complete payment through our secure checkout. This payment method may include: payment in Brazilian Reais (BRL); installment options (when available); currency exchange; international remittance; and transaction processing fees. Any applicable transaction fees, financing charges, exchange costs, or installment fees are charged by the payment provider and are the responsibility of the payer. These charges are displayed during checkout before payment confirmation.
Credit and debit card payments are securely processed through Stripe, our PCI DSS-compliant payment processor. Florida4Fun does not store or have access to customers' complete credit card information. For eligible reservations: a 30% deposit of the total reservation amount is charged at the time the reservation is confirmed, and the remaining balance is automatically charged to the same payment method 35 days prior to the scheduled Check-in Date. By completing the reservation, the Guest authorizes Florida4Fun and Stripe to automatically process the remaining balance on the scheduled payment date.
If the remaining balance cannot be successfully processed due to insufficient funds, an expired card, issuer decline, or any other payment issue, the Guest will be notified and requested to update the payment method or complete payment immediately. Failure to complete payment before the applicable deadline may result in cancellation of the reservation.
No Guest may occupy the property until the reservation has been paid in full. Additional fees may apply for optional services such as pool heating, BBQ grill rental, summer kitchen, mid-stay cleaning, or other optional amenities. Reservations originating from markets outside the United States may be subject to payment terms established by the respective sales channel.
A mandatory Damage Protection Fee is included in every reservation. This protection covers accidental damage to the property's interior, furniture, and appliances up to a maximum of $500. Damage must be reported immediately to the Property Manager. This protection does not cover:
The property is inspected before each arrival. The Guest agrees to:
Occupancy is strictly limited to the maximum number of guests specified for each property. Exceeding the maximum occupancy may result in immediate termination of the reservation without refund or an additional charge of $100 per unauthorized guest, per night, at the Property Owner's discretion.
Where available, telephones are intended for local calls only. Internet service is provided as a convenience. Florida4Fun and the Property Owner are not responsible for interruptions, outages, reduced speeds, or failures of internet, cable television, telephone, or utility services.
Pets are prohibited unless expressly authorized in writing before arrival. Unauthorized pets will result in a minimum $400 cleaning fee, in addition to any costs associated with damages, odor removal, or extra cleaning.
Smoking and vaping are strictly prohibited inside the property. Evidence of smoking inside the property will result in a minimum $400 cleaning fee, in addition to any costs required to restore the property.
All equipment and amenities are provided subject to availability and proper operation. Guests should promptly report any malfunction. While every reasonable effort will be made to resolve maintenance issues as quickly as possible, no refunds will be provided for temporary failures of appliances, air conditioning, televisions, internet service, laundry equipment, pools, spas, or similar amenities beyond the reasonable control of the Property Owner.
Maintenance issues must be reported within 24 hours of arrival. Failure to report problems within this period may result in the Guest being held responsible for any resulting damage. Service calls resulting from Guest misuse or where no problem is found may incur a $45 service charge.
Approved refunds will be processed using the original payment method whenever possible. Refund processing times vary depending on the payment processor, financial institution, or card issuer. Florida4Fun is not responsible for delays caused by banks, payment processors, or financial institutions.
Guests agree to comply with these Terms and Conditions and any additional instructions provided by the Property Owner, Property Manager, condominium association, or homeowners' association.
Guests occupy and use the property at their own risk. Neither Florida4Fun nor the Property Owner or Property Manager shall be liable for personal injury, illness, death, theft, loss of personal belongings, or property damage occurring during the stay, except where required by applicable law. Guests are financially responsible for damages beyond normal wear and tear caused by themselves or members of their party.
Parties, events, and gatherings involving unregistered guests are strictly prohibited. Quiet hours begin at 10:00 PM. Violations may result in immediate eviction without refund and additional fines imposed by the Property Owner or homeowners' association.
Due to Florida's tropical climate, insects such as ants, mosquitoes, palmetto bugs, and other native wildlife may occasionally be present despite regular pest control. No refunds will be issued for these naturally occurring conditions.
Pool or spa heating, when available, must be requested before arrival and may require an additional fee. Heating temperatures cannot be guaranteed, particularly when outdoor temperatures fall below 50°F (10°C).
Once a reservation has been confirmed, any cancellation request will be subject to the following policy.
More than 45 Days Before Check-In — Reservations canceled more than 45 days prior to the scheduled Check-in Date are eligible for a refund of the amount paid, less a 20% administrative fee.
45 Days or Less Before Check-In — Reservations canceled 45 days or less before the scheduled Check-in Date may be subject to cancellation charges of up to 100% of the total reservation amount, depending on the property's specific cancellation policy and any non-recoverable costs incurred by the Property Owner or Property Manager.
If the reserved property becomes unavailable due to sale, owner withdrawal, or circumstances beyond the Property Owner's reasonable control, the reservation will be canceled and all payments received by Florida4Fun will be refunded in full. Florida4Fun will make reasonable efforts to offer a comparable replacement property whenever possible; however, equivalent pricing, location, or availability cannot be guaranteed.
Florida4Fun, the Property Owner, Property Manager, condominium, and homeowners' association are not responsible for lost, delayed, stolen, or damaged packages. Guests should avoid scheduling deliveries before arrival or after departure.
An initial starter supply of toiletries and basic household items may be provided as a courtesy. Guests are responsible for purchasing any additional supplies needed during their stay.
Before departure, Guests are expected to:
Excessive cleaning, excessive trash, or failure to comply with departure instructions may result in additional cleaning charges, including a minimum $150 fee for excessive trash disposal.
These Terms and Conditions, as well as any reservation, rental agreement, or dispute arising from or relating to the reservation, occupancy, or use of any property booked through Florida4Fun, shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. The Guest agrees that any legal action, claim, or proceeding arising out of or relating to these Terms, the reservation, or the occupancy of the property shall be brought exclusively in the state or federal courts located in the State of Florida. The parties expressly consent to the exclusive jurisdiction and venue of such courts and waive any objection based on lack of personal jurisdiction, improper venue, or forum non conveniens. If any provision of these Terms and Conditions is determined to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
Guests acknowledge that COVID-19 and other communicable illnesses may exist despite reasonable cleaning procedures. Guests assume all risks associated with travel and occupancy and agree to follow any applicable public health guidance during their stay.
By accepting these Terms and occupying the property, the Guest voluntarily assumes all risks associated with the use of the property and agrees to release Florida4Fun, the Property Owner, and the Property Manager from liability to the fullest extent permitted by applicable law.
